Terms of use
These terms are the agreement between you and Markland Hill (the trading name of A Stott, "we", "us") for the use of our website and our Android game (together, "the products"). By using either of them you accept these terms. Our Wix add-ons have terms of their own — see section 3.
1. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the products for their intended purpose. We keep ownership of everything in them — code, artwork, text, audio, names and logos.
You may not:
- copy, sell, sublicense or redistribute any part of the products;
- reverse-engineer or decompile them, except where law says you may;
- modify a game client, automate play, or exploit a defect to gain an advantage;
- use them to break the law or to infringe anyone else's rights;
- attack, overload or probe our servers, or try to reach parts of them you have no right to.
2. Accounts
Some products need an account. Keep your sign-in details to yourself — you are responsible for what happens under your account. Tell us promptly if you think someone else has got into it.
We may suspend or close an account that breaks these terms. Where we reasonably can, we will tell you why first.
3. Wix add-ons
Our Wix add-ons are not covered by these terms. Each has terms of its own, which Wix shows you as part of installing it, and those are the ones that apply. For Bakehouse Collect they are the Bakehouse Collect terms.
4. Availability
We work to keep the products running but do not promise they will be uninterrupted or error-free. We may change, suspend or withdraw any part of them, and we deploy updates regularly. Some updates are required in order to keep using a product.
5. User content
Where a product lets you submit content — a company name in a game, a message through our enquiry form — you keep ownership of it, and you grant us the licence we need to operate the product and to respond to you. Do not submit anything unlawful, offensive, or belonging to somebody else. We may remove content that breaks this.
6. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
Subject to that:
- We are not liable for loss of profit, loss of business, loss of goodwill, loss of anticipated savings, or for any indirect or consequential loss.
- We are not liable for loss or corruption of data, including game progress, or for anything arising from Google Play, your device, or the other platforms the products run on.
- Subject to the exclusions and protections above, our total aggregate liability to you arising out of or in connection with the products or these terms, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited in any twelve-month period to the greater of: (a) the amount you paid us during that period; and (b) £25.
The products are provided on an “as is” basis, and except as stated in these terms all warranties and conditions implied by law are excluded to the fullest extent permitted.
If you are a consumer rather than a business, your statutory rights are unaffected by any of the above.
7. Privacy
How we handle personal data is set out in our privacy policy, which forms part of these terms.
8. Changes to these terms
We may update these terms. The date at the top shows when. If a change materially affects you, we will give reasonable notice in the product or by email. Continuing to use a product after a change means you accept the new terms.
9. Ending it
You can stop using the products at any time and delete your account from inside the app. We may end your licence if you materially break these terms. The sections that by their nature should survive — ownership, liability, and this clause — do.
10. Law and jurisdiction
These terms and any dispute arising out of them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction — except that if you are a consumer resident elsewhere in the UK, you may bring proceedings in your own jurisdiction.
